Patient's right to own their data

Under HIPAA, patients have the right to access their PHI and to request that their PHI be corrected or amended. Patients also have the right to request that their PHI be transferred to another healthcare provider or to receive a copy of their PHI in an electronic format.

Patients can exercise their HIPAA rights by submitting a written request to their healthcare provider or health plan. The provider or plan must respond to the request within 30 days.


How to protect your personal health records

In addition to HIPAA safeguards, there are a number of things that patients can do to protect their personal health records, including:

  • Be careful about who you share your PHI with. Only share your PHI with organizations that you trust.

  • Review your privacy settings on any apps or websites that you use to collect PHI.

  • Use strong passwords and enable two-factor authentication for all of your online accounts.

The Health Insurance Portability and Accountability Act (HIPAA) is a federal law that protects the privacy of patients' health information. HIPAA applies to healthcare providers, health plans, and other organizations that handle protected health information (PHI).

PHI is any information that can be used to identify an individual and relate to their past, present, or future physical or mental health condition. PHI includes information such as:

  • Medical history

  • Test results

  • Medications

  • Vaccinations

  • Insurance information

  • Genetic information
